In the following "Mavi" and the "customer" described in §2 of the Vote yield.
1 Scope, conceptual provisions
1. For the business relationship between Mavi and the customer, only the following general terms and conditions apply in their version valid at the time of the order. Different conditions of the customer are not recognized, unless Mavi expressly agrees to her validity.
2. The customer is a consumer, insofar as the purpose of the delivered deliveries and services cannot predominantly be attributed to its commercial or independent professional activity. In contrast, entrepreneur is every natural or legal person or legal partnership that acts in the exercise of their commercial or independent professional activity when concluding the contract.
2 Contract conclusion
1. The customer can select goods from the Mavi range, especially clothing and collect them in a so -called shopping cart via the "In the shopping cart" button. Via the "Order in payment" button, he provides a binding offer to conclude a purchase contract about the goods in the shopping cart. Before sending the order, the customer can change and view the data at any time.
2. MAVI then sends the customer an automatic order confirmation by email in which the customer's order is listed again. The automatic order confirmation only documents that the customer's order has been received by Mavi and does not constitute acceptance of the application. The contract only comes about by the delivery of the ordered goods. In this email or in a separate email, but at the latest when the goods are delivered, the contract text (consisting of order, terms and conditions and order confirmation) will be sent to the customer on a permanent data carrier (email or paper printout). The contract text is stored while data protection.
3. The contract is concluded in German.
3 delivery, availability
1. Delivery times specified are calculated from the time of our order confirmation, provided prior payment of the purchase price (except for purchase in account, if accepted as a payment method). If there is no or no different delivery time for the respective goods in our online shop, The estimated delivery time is 1-5 working days.
2. If the delivery of the goods ordered by the customer is not possible, for example because the corresponding goods are not in stock, Mavi refrains from a declaration. In this case, a contract does not come about. MAVI will inform the customer immediately and reimburse the considerations that have already been received.
3. If the product specified by the customer in the order is only temporarily not available, the provider also informs the customer immediately in the order confirmation. With a delivery delay of more than two weeks, the customer has the right to withdraw from the contract. The statutory right of withdrawal of the customer (see § 9 of these contractual terms) is not affected by this. In this case, Mavi is also entitled to remove from the contract. Here he will immediately reimburse the customer's payments made.
4. There are the following delivery restrictions: Mavi only delivers to customers who have their habitual residence (billing address) in Germany or Austria and can specify a delivery address in the same country.
4 Removal
The goods delivered remain the property of Mavi until full payment.
5 prices and shipping costs
1. All prices specified on the Mavi website include the applicable statutory sales tax.
2. The corresponding shipping costs are given to the customer in the order form and are to be borne by the customer, provided that the customer does not exercise his right of withdrawal before Mavi is dispatched.

6 payment modalities, action vouchers
1. The customer can make payment by credit card, prepayment, on account or by pay-pal.
2. The payment of the purchase price is due directly with the conclusion of the contract. If the due date of the payment after the calendar is determined, the customer is already in arrears by failing the appointment. In this case, he has to pay Mavi default interest of 5 percentage points above the base rate.
3. The customer's obligation to pay default interest does not rule out the assertion of further default damage by the provider.
4. Action vouchers (voucher that the customer cannot buy, but the MAVI issues with a certain validity period as part of advertising campaigns) are only for the website www.mavistore.de and only valid in the specified period. Only one voucher can be used as part of an order process. The value of the order must at least correspond to the amount of the action voucher. It is not possible to pay for the value of the action voucher or any remaining estate.
5. Action vouchers can only be redeemed before the ordering process is completed. Subsequent offsetting is not possible. The action voucher cannot be transferred to third parties. Several action vouchers cannot be combined. If the total purchase price of the order is higher than the credit of the redeemed action voucher, the remaining amount can be compensated for by the customer offered.
6. If the right of cancellation, resignation or other reversal of the purchase contract, the action voucher will not be reimbursed in money. MAVI will send a new action voucher to the customer with the validity still existing at the time of the order.
7 Sach defenders, guarantee
1. The provider is liable for material defects in accordance with the legal regulations applicable for this, in particular §§ 434 ff. BGB. The warranty period for consumers is 24 months. The warranty period on goods supplied by Mavi is 12 months to entrepreneurs.
2. An additional guarantee only exists for the goods delivered by Mavi if it was expressly submitted to the respective article in the order confirmation.
8 liability
1. Claims of the customer for compensation are excluded. This does not apply to the customer's claims for damages from the violation of life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damage based on an intentional or grossly negligent breach of duty by Mavi, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the goal of the contract.
2. In the case of the violation of essential contractual obligations, Mavi is only liable to the contractual, predictable damage if it was simply caused negligent, unless it is claims for damages by the customer from a violation of life, body or health.
3. The restrictions of paragraphs 1 and 2 also apply in favor of Mavi's legal representatives and vicarious agents if claims are asserted directly against them.
4. The provisions of the Product Liability Act remain unaffected.
9 cancellation policy
When concluding a distance sales, consumers generally informed a legal right of withdrawal, about the MAVI in accordance with the legal pattern below.
You have the right to revoke this contract within fourteen days without any reasons.
The cancellation period is fourteen days from the day on which you or a third party named by you, who is not a carrier, have or has taken possession of goods.

Consequences of the revocation
If you cancel this contract, we have to pay you all payments we received from you, including the delivery costs, immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment we use the same means of payment that you used in the original transaction, unless something else has been expressly agreed with them; Under no circumstances will you be charged for fees for this repayment.
We can refuse the repayment until we have returned the goods or until you have provided the proof that you have returned the goods, depending on which the earlier time is.
You have the goods immediately and in any case at the latest within fourteen days from the day on which you inform us of the revocation of this contract, to Mavi Europe AG C/O BLG GmbH & Co. KG, Hugo-Junkers-Str. 7, 60386 Frankfurt am Main to return or hand over. The deadline is preserved if you send the goods before the deadline of fourteen days.
We bear the costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to the quality, properties and functionality of the goods not necessary to deal with them.

11 final provisions
1. The law of the Federal Republic of Germany is applied to contracts between Mavi and the customer, excluding the UN sales law. The legal regulations for the restriction of the choice of law and the applicability of mandatory provisions in particular of the state in which the customer has his habitual residence remain unaffected.
2. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes from contractual relationships between the customer Mavi is the seat of Mavi.
3. The seller is neither obliged to participate in a dispute settlement procedure in front of this consumer arbitration board, nor does he voluntarily agree to do so.
